Any personal data you share with us is handled with the utmost care and in accordance with applicable privacy laws of the Privacy Regulation of 27 April 2016 (Regulation 2016/679 of the European Parliament and of the Council on the protection of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

2. What Information We Collect

We may collect the following types of personal data:

We do not sell or rent your data. 5. What We Do With Your Data

La Cinquième collects and processes your data for various purposes and based on different justifications. For each purpose, only the relevant data are processed. La Cinquième makes reasonable efforts to ensure that personal data is accurate, correct and up to date. These personal data are only kept for the duration necessary for the applicable purposes or for legal reasons.

Pre-contract assessment

Prior to entering into contracts, La Cinquième may need to process certain data in order to process an application and make a sound judgment about the desirability of entering into the contract and/or about the conditions under which a contract will be entered into. An example is the data collection and processing of a Lease application.

Execution of the agreement

Within the framework of the relationship with the client, there are various tasks to be performed and the services called upon by the client must be processed administratively and for accounting purposes. To do so, in some circumstances certain personal data must be transferred to an intermediary or counterparty (for example, a credit intermediary, a custodian, a bank agent, a lawyer, etc.).

 

Legitimate interests

In addition to the purposes listed above, La Cinquième has a number of legitimate interests that serve as the basis for some processing of personal data. In doing so, La Cinquième is careful to minimize the impact on your privacy and, in any case, not to upset the balance with any impact on your privacy.

Direct marketing

In order to carry out marketing activities, we process personal data of our (potential) relations, such as address data, e-mail address and your visit to our web pages. On the basis of data from internal, external sources and your visit to our web pages, La Cinquième can make you appropriate and targeted commercial offers, for example by mail, telephone or internet.

La Cinquième does not sell or rent your personal information to third parties.

Access and update your data

  • You have the right to inspect the personal data processed by us. If you exercise your right of inspection, La Cinquième will provide you with as complete an overview of your data as possible.

  • Certain data that are not part of commonly processed personal data, such as backup files, log, history or archive files, may not be included in this overview. However, these are removed from these files according to standard cleanup processes.

  • If your personal data is incorrect, you have the right to ask us to correct it.

  • If we have shared information about you with third parties and that information has subsequently been corrected, those third parties will be notified.

 

Request deletion of your data

  • You may ask La Cinquième to delete your data. If La Cinquième no longer has a compelling reason for processing your data, it will be automatically deleted.

Limit the processing of your date

You have the right to ask us to limit the use of your personal data in the following cases, among others

  • You believe that the information is incorrect or that we are processing the data unlawfully. During the time period required by La Cinquième to make verifications regarding the exercise of this right.

  • Pending La Cinquième's response as to whether legitimate grounds of La Cinquième outweigh those of you in the event you have objected to the use of your data for legitimate interests.

  • In the event that La Cinquième no longer needs your data, you have the right to request to keep your data for a longer period of time so that you can use it to safeguard your rights in a legal dispute.

You have the right to object to decisions based solely on automatic processing of your personal data that may have a significant or legal impact on you. In such cases, you may ask to have "a person" decide.

7. What We Do With Your Data & Why

To provide you with the best possible services and remain competitive, we share certain information inside and outside of La Cinquième.

 

This includes:

  • Independent Suppliers: We share information with independent suppliers who have partnered with La Cinquième. These suppliers are registered in accordance with applicable laws and regulations and operate with the necessary authorization from regulatory authorities.

  • Service providers: When we use other service providers, we share only that personal data necessary for a specific job in the best interest of La Cinquième. Service providers help us by, among other things:

    • Design and maintain Internet tools and web applications;

    • Provide marketing activities, events or communication with clients;

    • Prepare reports and statistics, print materials and design products.

  • Research and innovation: We are always looking for new insights that will enable you to always stay one step ahead, both privately and professionally. To this end, we may share personal data for research purposes with partners such as universities and innovators. The partners with whom we work must meet the same strict requirements as La Cinquième employees. Personal data is shared in aggregated form and research results are anonymous.

 

We always ensure that third parties only have access to personal data necessary for their specific mission.

Communication of personal data abroad

When we share your personal data internally or with third parties abroad, we always provide appropriate safeguards to protect such data. For countries outside the European Union whose local laws and security are considered inadequate, La Cinquième relies, among other things, on:

  • Whether the contract or transaction with you or a third party, is in your favor;

  • European Union model contracts: these contain standard clauses used in agreements with service providers to ensure that the transfer of data to countries outside the European Economic Area complies with European data protection laws and regulations.

At your request, we can provide a copy of these clauses;

  • Transfer of data necessary in the public interest;

  • Your explicit consent.

8. Obligation To Provide Accurate Data

We need certain information about you in order to fulfill our legal and related contractual obligations as a Event Manager. Without this information, we cannot perform services for you.

The client represents and warrants that, when providing personal data to La Cinquième for processing:

  • The relevant data subjects were adequately informed of their rights and obligations, and in particular of the possibility that La Cinquième will process personal data for the benefit of the client and in accordance with the client's instructions;

  • It has complied with applicable data protection and processing laws in collecting and providing such personal data;

  • It will take all reasonable steps to keep the personal data up to date to ensure that the data is not incomplete or inaccurate with respect to the purposes for which it was collected.

9. How We Protect Your Data

La Cinquième has internal policies and minimum standards to protect your data. These are regularly adapted to new regulations and developments in the market. More specifically, and in accordance with applicable laws and regulations, we take appropriate technical and organizational measures (policies and procedures, IT security and so on) to ensure the confidentiality and integrity of your personal data, as well as the way it is processed.

In addition, La Cinquième employees are required to maintain confidentiality and - with exceptions - may not disclose your personal information unlawfully or unnecessarily.

10. What You Can Do To Protect Your Data

We make every effort to protect your data, but you yourself can consider the following measures to secure your data:

  • Install antivirus software, anti-spyware software and a firewall. In "your preferences," set to update that protection often;

  • Keep passwords strictly confidential and use strong passwords - avoid obvious combinations of letters and numbers;

  • Be careful of anything unusual, such as a new Internet address, or unusual requests, such as a request to forward customer information by e-mail.

11. How Long We Keep Your Data

We may keep your personal data for as long as it is needed for the purpose for which it was originally collected. After that period, we look at viable solutions such as archiving.

In deciding how long to keep personal data, we must also take into account the retention obligations that other applicable laws may impose (for example, anti-money laundering laws). We may also retain your personal data as evidence in any legal proceedings. In that case, such personal data will not be actively used.

Consequently, there is no general retention period - it varies depending on the circumstances. We will keep your personal data for as long as we have a (contact) commercial relationship or longer if required by law.

12. Duty To Report Data Breaches

La Cinquième will inform the client as soon as possible of any breaches of its security that must be reported to the Belgian Data Protection Authority and/or the data subject(s).

Upon the client's request, in the event of a breach, La Cinquième will provide him with at least the following information:

  • The nature of the breach and of the personal data affected;

  • The likely consequences of the breach;

  • the measures that are or have been taken in that regard.

 If it is not possible for La Cinquième to provide this information immediately, it will do so in stages. La Cinquième will provide all necessary cooperation to help provide additional information to the supervisor(s) and/or data subject(s), if necessary.

La Cinquième maintains a record of the facts and consequences of security breaches.
